Contrary to what many might believe, it is not illegal to consume alcohol and get behind the wheel. While this is not recommended, doing so does not automatically guarantee that that individual is guilty of DUI. The State, if pursuing a DUI charge, must establish beyond a reasonable doubt that the adult driving the vehicle had a blood alcohol content of or over 0.08. Although, it should be noted, if an individual is cited for DUI and has a BAC under 0.08, the State can still pursue the charge of DUI. In that scenario, the State must utilize the evidence obtained by law enforcement to establish that the driver was operating a motor vehicle while under the effects of alcohol and/or drugs.
